MEMORANDUM AND ORDER
LIMBAUGH, District Judge.
This matter is before the Court on the motion of defendant for summary judgment. Defendant's motion will be granted, and this action will be dismissed.
Plaintiffs were employees of the Missouri Dept. of Social Services. Beginning in 1972 plaintiffs were exposed to a substance manufactured by defendant, but not shown by plaintiffs to have contained asbestos. In 1983 plaintiffs were diagnosed as having developed mesothelioma, a type of lung cancer induced by asbestos. Plaintiffs seek recovery in tort for their injuries, and under the Missouri workers' compensation statute.
The Missouri workers' compensation statute provides that the employer's liability for the compensation payments is to be exclusive. § 287.120(1) R.S.Mo. (1978). This exclusion of tort liability of the employer has been held to encompass not only first-party tort claims by the employee, but also third-party tort claims of other workers who may be affected by the employee's injuries. See, e.g., Lawrence v. Aero Lodge No. 735, Intern. Ass'n. of Machinists, 374 S.W.2d 405, 412-13 (Mo.1964). 0b46394aab
